Privacy Policy

Overview

Vital Logic LLC ("Vital Logic," "we," "us," or "our") is a registered software development company that builds and publishes mobile applications (collectively, the "Apps"). This Privacy Policy explains what information we collect through the Apps and this website, how we use it, and the choices you have. It applies to all applications published by Vital Logic LLC, unless a specific app provides a separate privacy notice.

By using any of our Apps or this website, you agree to the collection and use of information as described in this policy.

Information We Collect

We aim to collect only what is needed for our Apps to function. Depending on the app, this may include:

• Information you provide directly — such as account details, settings, or content you create within an app (for example, photos or labels you add to organize items in Tidy Mind, or workout logs, food logs, and profile goals you enter in Pinnacle Fase).
• Health, fitness, and body profile information (Pinnacle Fase) — if you use Pinnacle Fase, you may optionally enter or sync fitness and wellness information such as height, weight, age, biological sex, fitness goals, workout logs, food/nutrition entries, optional reproductive/maternal status (such as pregnancy trimester or postpartum/lactation status used to adjust calorie and exercise recommendations), and optional joint or muscle pain/rehabilitation limitations. With your explicit permission, Pinnacle Fase can also read and write selected health metrics through Android Health Connect or Apple HealthKit (see Health & Fitness Data (Pinnacle Fase) below for full details).
• Device and usage data — general information such as device type, operating system version, app version, crash logs, and basic usage analytics that help us fix bugs and improve the Apps.
• Sign-in information — some Apps, such as Tidy Mind, let you sign in with your Google account or, on iOS, with Sign in with Apple. If you do, we receive basic profile information from Google or Apple, such as your name and email address (which may be a private relay address if you choose to hide your email on Apple), so we can sign you in.
• Purchase and subscription information — if you buy a subscription, Google Play (on Android) or the Apple App Store (on iOS) processes your payment, and we do not receive your card or payment details. We receive limited purchase information, such as which subscription you hold, its status and renewal dates, and an app user identifier, through the app store and RevenueCat so we can unlock paid features.
• Content you submit to AI-powered features — some Apps, such as Tidy Mind, send content you provide to the Google Gemini API, accessed through Firebase, to generate responses. That content is processed by Google under Google's own terms and privacy policy.
• Media you choose to provide — some Apps let you take or upload photos or use the camera for features you engage directly (for example, tagging a photo of an item in Tidy Mind, or scanning a food barcode or running an on-device workout form check in Pinnacle Fase). This media is used only to power the feature you engaged, and is not sold or used for advertising profiling.
• Business contact information — for our business-facing apps, we may process caller or message details on behalf of the business customer using the service, solely to deliver that service.

We do not knowingly collect sensitive personal information beyond what is necessary for the specific feature you use, and we do not collect precise location unless a specific app feature requires it and you grant permission.

Health & Fitness Data (Pinnacle Fase)

Pinnacle Fase is designed with an offline-first architecture. All workout history, nutrition and water logs, body measurements, profile settings, and synced health records are stored locally on your device. Vital Logic LLC does not operate a remote cloud database that collects or stores your personal health records.

When you explicitly connect Pinnacle Fase to Android Health Connect (on Android) or Apple HealthKit (on iOS), Pinnacle Fase requests access only to the specific health data types you authorize and uses them solely for the user-facing health and fitness features described below:

• Steps (READ_STEPS) — Pinnacle Fase reads your daily step count from Health Connect or HealthKit to display your daily and weekly step progress on the Today and Progress tabs, award step-consistency milestones, and automatically calibrate your daily activity-level multiplier for personalized calorie and macronutrient budgets.
• Exercise Sessions (WRITE_EXERCISE) — When you complete a guided strength, cardio, mobility, or rehabilitation workout in Pinnacle Fase, the app writes the completed exercise session (start time, end time, and workout title) to Health Connect or HealthKit so your connected fitness dashboards and activity rings stay in sync.
• Body Weight (READ_WEIGHT & WRITE_WEIGHT) — Pinnacle Fase reads weight records (such as smart-scale weigh-ins) from Health Connect or HealthKit and writes weigh-ins you log inside Pinnacle Fase back to Health Connect or HealthKit. Weight data is used to render your weight-trend chart, calculate progressive overload and body-weight exercise loads, and dynamically adjust your daily calorie and macronutrient targets.
• Heart Rate (READ_HEART_RATE) — When you complete a workout, Pinnacle Fase reads heart rate samples recorded during that active workout window (between workout start and finish) to display your average workout heart rate and estimate active calories burned using the validated heart-rate energy expenditure equation (Keytel et al., 2005) on your workout summary and workout history log.

Optional Profile, Maternal & Rehabilitation Customizations: Within Pinnacle Fase, you may optionally configure biological profile fields (age, height, weight, biological sex), maternal status (pregnancy by trimester or postpartum/breastfeeding status), and joint or muscle pain/rehabilitation areas (such as shoulder, lower back, knee, or elbow/wrist sensitivity, or post-workout soreness feedback). These inputs are processed entirely on your device to adjust estimated energy expenditure (such as trimester and lactation calorie allowances), recommend prenatal or pelvic-floor mobility routines, or substitute lower-impact and physical-therapy rehabilitation exercises.

Limited Use & Health Data Privacy Commitments:

• The use of information received from Android Health Connect adheres to the Google Play Health Connect Permissions Policy, including the Limited Use requirements, and information received from Apple HealthKit adheres to Apple's HealthKit guidelines.
• Health and fitness data accessed through Health Connect or HealthKit (and any health information entered into Pinnacle Fase) is never sold to third parties, data brokers, or information resellers.
• Health and fitness data is never used or transferred for advertising, remarketing, personalized ads, or marketing purposes, and is never shared with advertising networks.
• Health and fitness data is never used for creditworthiness, lending, insurance underwriting, or employment decisions.
• You can revoke Health Connect or HealthKit permissions at any time in your device's system settings, and you can permanently delete all local Pinnacle Fase data at any time from inside the app under You → Settings (or by uninstalling the app).

How We Use Information

• To provide, operate, and maintain the Apps and their features (including personalized workout programming, exercise adaptations, step and weight tracking, workout calorie estimation, and nutrition logging in Pinnacle Fase);
• To synchronize your workouts, step counts, weight records, and workout heart rate with Android Health Connect or Apple HealthKit when you explicitly enable health syncing;
• To diagnose problems, fix bugs, and improve performance and reliability;
• To respond to support requests sent to us directly;
• To process subscriptions and unlock the paid features you have purchased;
• To provide AI-powered features that you choose to use;
• To display advertising in free, ad-supported versions of our Apps, where applicable (note: health and fitness data from Pinnacle Fase is never used for advertising);
• To comply with legal obligations and enforce our Terms of Service.

How We Share Information

We do not sell your photos, your health and fitness data, the content you create in our Apps, or what you store in them. We may share limited data with:

• Service providers who help us operate the Apps, such as cloud hosting, crash reporting, and analytics providers, bound to use data only to perform services for us.
• Android Health Connect and Apple HealthKit, solely on your device and at your direction when you enable health syncing in Pinnacle Fase, to read or write the specific health records you have authorized.
• Open Food Facts (in Pinnacle Fase), when you scan a food barcode or search the public food database. Only the barcode number or food search query is sent to the public Open Food Facts API (world.openfoodfacts.org) to retrieve nutrition facts; no personal identity or health profile data is transmitted.
• Apple, for Sign in with Apple and App Store billing on iOS, under Apple's own privacy policy.
• Google, for sign-in, Google Play billing, and AI-powered features that use the Google Gemini API, and household live sync and notifications through Firebase, under Google's own privacy policy.
• RevenueCat, our subscription management provider, which receives limited purchase information and an app user identifier to verify subscriptions and manage access to paid features, under its own privacy policy.
• Advertising partners (in ad-supported Apps only), such as Google AdMob, which may collect and use device identifiers and similar data to serve and measure ads under their own privacy policies. Some privacy laws treat this kind of sharing as "sharing" or a "sale" for advertising purposes. Health and fitness data from Pinnacle Fase is never shared with advertising partners. Premium subscriptions remove ads in Tidy Mind, and you can limit ad personalization in your device's ad settings (on Android: Settings → Google → Ads; on iPhone: Settings → Privacy & Security → Tracking). Our Apps for young children will not show ads.
• Legal or safety reasons, if required by law or to protect the rights, property, or safety of Vital Logic LLC, our users, or the public.

Device Permissions

Individual Apps may request device permissions (such as camera, photo library, microphone, or health data access) that are directly tied to a feature of that app. Permissions are only used for the purpose disclosed at the time of the request, and you can review or revoke them at any time in your device settings:

• Camera (CAMERA) — Used in Tidy Mind when you take photos to organize items, and in Pinnacle Fase when you scan a food barcode for nutrition logging or use the live workout form-check and rep-counter camera. In Pinnacle Fase, camera video frames are processed in real time on your device and are never uploaded to our servers.
• Health Connect / HealthKit Permissions — Used in Pinnacle Fase only when you opt in to sync steps, workouts, body weight, or workout heart rate (see Health & Fitness Data (Pinnacle Fase) above).
• Microphone — Planned for speaking lessons in El Rincón Del Coquí, processed on-device.

Data Retention

We retain information only as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. For offline-first apps like Pinnacle Fase, your workout, nutrition, profile, and synced health records remain stored locally on your device until you clear them in the app's settings or uninstall the app. You may also request deletion of any data held by us as described in "Your Choices & Rights" below.

Children's Privacy (COPPA & GDPR-K)

Vital Logic LLC makes apps for people of all ages, and different apps are designed for different audiences.

Apps designed for adults and older teens. Apps such as Tidy Mind and Pinnacle Fase are not directed at children under 13 (or under the minimum age set by local law, which is higher in some jurisdictions). We do not knowingly collect personal information from children under that age through these Apps. If you believe a child has provided us with personal information, please contact us at support@vitallogic.net so we can promptly delete it.

Apps designed for young children (El Rincón Del Coquí). Some of our Apps, specifically El Rincón Del Coquí (in production), are built specifically for young children (ages 2 to 5) to use with a parent or guardian. We are committed to upholding the highest standards of child data protection, in full compliance with the U.S. Children's Online Privacy Protection Act (COPPA), the General Data Protection Regulation for Kids (GDPR-K), Google Play's Families Policy, and Apple's Kids Category Guidelines:

• 100% Offline & No Cloud Profiling: El Rincón Del Coquí is engineered with an offline-first architecture. All game progress, lesson completions, and interactive activities remain strictly on the local device. Vital Logic LLC does not operate remote servers or user databases that collect, store, or monitor child profiles.
• Zero Personal Data Collection: We do not require, request, or collect any personal identifiers from children, including names, email addresses, phone numbers, persistent device identifiers for advertising, or physical locations.
• No Third-Party Trackers or Analytics: The app does not bundle any third-party behavioral analytics SDKs, crash reporters that log personal data, social media sharing plugins, or remarketing tools.
• Zero Advertising: There are no third-party advertisements, behavioral ads, contextual ad banners, or sponsored content in El Rincón Del Coquí. Ever.
• On-Device Audio Processing (Microphone): If an interactive speaking or pronunciation lesson requests microphone access, voice input is processed purely in real time on the device's local speech processor. Voice samples are never recorded, never written to disk, and never transmitted over the internet to us or any third party.
• Gated In-App Purchases: Any optional paid content or digital lesson expansions are gated behind a secure parental consent gate (requiring adult verification) and processed entirely through Google Play or Apple App Store in-app billing. Vital Logic LLC never receives or stores payment card information.
• Parental Rights & Inquiries: Parents and legal guardians have the right to review, refuse, or request the deletion of any data associated with their child. Because El Rincón Del Coquí stores all progress locally, parents can permanently erase all app data at any time by clearing the app's local storage in device settings or uninstalling the app. For any questions, parents may contact us directly at support@vitallogic.net.

Security

We use reasonable administrative and technical safeguards to protect information from unauthorized access, disclosure, or loss. No method of electronic storage or transmission is completely secure, so we cannot guarantee absolute security.

Your Choices & Rights

Depending on your location, you may have the right to access, correct, or delete your personal information, or to object to certain processing. If you are a resident of certain regions — such as California or the European Union/United Kingdom — you may have additional statutory rights regarding your personal data, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of certain sharing or processing. To exercise any of these rights, contact us at support@vitallogic.net and we will respond in accordance with applicable law.

For Tidy Mind, you can find step-by-step instructions for cancelling your subscription, deleting the app, and removing data used by live sync on our subscription and data deletion page. Subscriptions are billed and managed by Google Play or the Apple App Store, not by Vital Logic LLC.

Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Apps after a change constitutes acceptance of the revised policy.
