Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the applications published by Vital Logic LLC ("Vital Logic," "we," "us," or "our"), and this website (collectively, the "Services"). By downloading, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Use of Our Apps
You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not: (a) reverse engineer, decompile, or attempt to extract the source code of any app, except where permitted by law; (b) use the Services to distribute malware or unauthorized advertising; (c) interfere with or disrupt the integrity or performance of the Services; or (d) use the Services in a way that violates any applicable law or regulation.
Eligibility
Our apps are made for different audiences. Apps such as Tidy Mind and Pinnacle Fase are intended for adults and older teens: you must be at least 13 years old (or the minimum age required in your country) to use them, and if you are under 18, you should use them with a parent or guardian's permission. Apps designed for young children are intended to be used with a parent or guardian, who is responsible for the child's use and for any purchases. Purchases are made through Google Play or the Apple App Store under their own terms.
Accounts
Some Services may require you to create an account or provide certain information. You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity that occurs under it. Notify us promptly of any unauthorized use.
User Content
Certain Apps allow you to create or upload content, such as photos, labels, or notes ("User Content"). You retain ownership of your User Content. By submitting User Content through a feature that requires it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely to operate and provide the relevant feature to you. We do not claim ownership of your User Content.
Subscriptions and Billing
Some features of our Apps, such as Tidy Mind Premium and Premium Plus, are available only with a paid subscription. Subscriptions are offered on a monthly or yearly basis. The price and billing period are shown before you subscribe. Payment is charged to your Google Play account if you subscribe on Android, or to your Apple Account if you subscribe on iOS, when you confirm your purchase.
Subscriptions renew automatically at the end of each billing period until you cancel. On Android, you can cancel at any time in the Google Play app under Payments & subscriptions, then Subscriptions. On iOS, you can cancel at any time in your device's Settings by tapping your name and then Subscriptions. To avoid being charged for the next period, cancel at least 24 hours before the end of the current period. After you cancel, you keep access to paid features until the end of the period you have already paid for. Uninstalling an app does not cancel your subscription.
Billing, payment processing, and refunds are handled by Google Play or the Apple App Store, depending on where you subscribed, and are subject to that store's terms and refund policies. If you have a billing question, you can also contact us at support@vitallogic.net. If a subscription price changes, the store will notify you and, where required, ask for your consent before the new price applies.
If you reinstall an app or switch devices, you can use the Restore purchases option in the app to regain access to a subscription tied to the same Google account or Apple Account. We use RevenueCat to help manage subscription status; see our Privacy Policy for details.
Intellectual Property
The Services, including all software, designs, text, graphics, and trademarks, are owned by Vital Logic LLC or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Services, no other rights are granted.
Third-Party Services
Our Apps may use or link to third-party services (such as analytics, cloud infrastructure, or advertising networks) that have their own terms and privacy practices. We are not responsible for the practices of third parties, and we encourage you to review their policies separately.
Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
Limitation of Liability
To the fullest extent permitted by law, Vital Logic LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.
Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms. You may stop using the Services at any time by uninstalling the relevant app.
Changes to These Terms
We may revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Services after a change constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law principles.
